Planning Permission Expiry in Cyprus: How Not to Lose Your Permit

A planning permission is not permanent. It has a life, and if it expires before you build or before you take the next legal step, you can be left starting again. Worse, one very common assumption about extending a permit is flatly wrong, and it catches out owners and professionals alike. Here’s how validity actually works.

How long does a planning permission last

People often say “three years.” That’s only the fallback. Under the planning law (Ν. 90/1972, art. 28), the three-year period applies only where the permit imposes no condition setting a different term. In practice, a condition almost always applies, and the periods are longer, and they differ depending on whether you’re building on a registered plot (οικόπεδο) or a field (χωράφι):

A definitional note that trips people up: for these periods, a “unit” is one plot, one dwelling, or one tourist/hospital room, and for commercial or leisure schemes, one unit is counted for every 60 m² of useful area. So a 600 m² commercial building is treated as ten “units.”

The mistake that costs permits: “amending my plans resets the clock”

It does not. The Department’s own manual singles this out, warning that it is “often misinterpreted by applicants and designers.”

When you get approval of amended plans (Πολεοδομική Έγκριση), the validity of your permit stays exactly as it was. Unless you file an extension application at the same time, the original expiry date still governs, and the authority now prints a warning note to that effect on the approval.

And even when you do extend alongside an amendment, the extension runs from the original expiry date, not from the date the amendment is approved. Assuming otherwise is how a permit quietly lapses while its owner believes it’s been “refreshed.”

Extending before expiry

To keep a permit alive, you apply for an Extension of Validity (Παράταση Ισχύος / form ΕΑ11) before it expires. The extension is granted within the statutory maxima in the table above, so a permit can’t be extended indefinitely.

Older permits have their own transitional rules. Permits granted before 8 April 2011 and permits that lapsed before 31 December 2017 fall under differentiated maximum periods. In some of these cases, a further extension is possible, for example, an extra 2 years for a single unit, or 5 years for other cases, provided the application is made three months before expiry, and the development is at least 30% complete. (Εγχειρίδιο §6.2.)

Why “change of use” owners need to watch this closely

Change-of-use permits carry the shortest absolute life, 8 years, versus 12 for most other categories. If you’ve converted a property’s use and are phasing the works, that ceiling arrives sooner than you might expect.

Practical rules to protect your permit

  • Diarise the real expiry date – the one on the permit, not a vague “three years.”
  • Never assume an amendment extends it. If you’re amending late in a permit’s life, file the extension in parallel.
  • Apply to extend early – and note the “three months before expiry / 30% complete” conditions that apply to the older transitional cases.
  • Know your category’s ceiling – especially change of use (8 years).
